The owner of the online store Lingeriz.com (hereinafter referred to as the online store) is Frenor OÜ,(14619513), located at Estonia, 10131 Tallinn, Tatari 56/105, Customer Care at help@lingeriz.com.

1.  Validity of contract of sale, product and price information

The conditions of sale apply to purchases of goods from the online store.

The prices of the products sold in the online store are indicated next to the products. A fee for shipping is added to the price.

The shipping cost depends on the location of the purchaser and the shipping method. The shipping cost is displayed when the purchaser places the order.

Delivery time is provided immediately adjacent to the product in the online store, all products have specific delivery time.

Product information is provided immediately adjacent to the product in the online store.

 

2.  Placing an order

2.1  In order to place an order for the purchase of one or more products on lingeriz.com, you must fill in the online order form and send it electronically to Frenor OÜ.

Add the desired products to your shopping basket to order them. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid via an online bank transfer or using another payment method.

The contract enters into force when the amount payable is transferred to the bank account of the online store. 

After your order form has been submitted, Frenor OÜ will process your order.

Frenor OÜ may not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are no longer available. In the above cases, we shall inform you by email that the contract has not been executed and that Frenor OÜ has not carried out your purchase order specifying the reasons thereof. If the products displayed on lingeriz.com are no longer available at the time of your last access or once Frenor OÜ has received your order form, Frenor OÜ shall inform you of the unavailability of the ordered products within fourteen (14) days of the day after Frenor OÜ has received your order.
If the order form has been sent and the price has been paid for items that are no longer available, Frenor OÜ will refund the amount paid for those items no later than within 14 days of receiving the notification, and the contract between the parties will be deemed to have been terminated.

2.2  Before purchasing the products, you will be asked on the order form to carefully read the Terms and Conditions .

2.3 Upon submission of an order form, Frenor OÜ shall send you a purchase order receipt email, containing a summary of the information related to the order form (General Terms and Conditions, the products' main characteristics, detailed information on price, terms of payment, shipping costs).

2.4 We would like to remind you that all items purchased are intended for use in the country they were ordered from. If, however, you decide to take the items to another country, you will be responsible for adhering to both the exportation legislation of the order country and the importation legislation of the destination country. Frenor OÜ shall not be held liable.

 

3.  Guarantees and Product Price Indication

3.1  On lingeriz.com, we offer for sale quality products. These products are purchased by Frenor OÜ directly from the manufacturers and dealers, carefully selected.

3.2  Frenor OÜ does not sell second-hand products, flawed products or products of lower quality than the corresponding market standards.

3.3  The main characteristics of products are shown on lingeriz.com on each product page. The products offered for sale on lingeriz.com may not exactly correspond to the real garments in terms of image and colours due to the Internet browser or monitor used.

3.4  Prices are subject to change. Check the final price of sale before sending the relevant order form.

3.5  All products come with an identification tag attached. Do not remove the tag from the purchased products should you wish to return the purchased product.

3.7  In accordance with consumer protection legislation, you will be liable for any decrease in the value of products purchased on lingeriz.com resulting from any use of the same products other than that which is necessary to verify their nature, characteristics and functionality. Therefore, should you decide to exercise your right to return purchased products, Frenor OÜ has the right to not accept returned products or to not fully refund the amounts paid for purchased products that are returned without the corresponding tag or that have been altered from their original status or damaged.

 

4.  Delivery time and shipment

All products have specific delivery time, written in the product information form.

Goods are shipped internationally via Courier. Many of the countries: Latvia, Lithuainia, Finland, Sweden, Germay there is also shipment via DPD Parcelshop available. Note that international payments are possible with Credit Card.

The purchaser bears the shipping cost and the respective price information is displayed next to the shipping method.

All shipments arrive at the destination specified by the purchaser within 6 working days at most from the date the package was handed over to the Courier. The parcel will be returned to the sender in 14 days from the first attempt to deliver it to the purchaser. In that case if the purchaser still wishes to receive the package, he or she must bear the shipping cost once more. 

We have the right to ship goods in up to 45 calendar days in exceptional cases.

Note that every product has specific delivery time and 6 days at most mentioned above is not included into that delivery time.

 

5.  Right of withdrawal

5.1  After receiving the order, the purchaser has the right to withdraw from the contract entered into with the e-store within 14 days. 

5.2  Depending on the product, the purchaser may not necessarily have the right of withdrawal; in such a case the corresponding products and services must be listed and they must comply with the conditions provided for in subsection 53(4) in the Law of Obligations Act.

5.3  The right of withdrawal does not apply if the purchaser is a legal person.

5.4  To exercise the 14-day right of withdrawal, you must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics and functioning of the goods in the same way you would be allowed to test the goods in an actual store.

5.5  If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics and functioning of the goods, or if there are any signs of use or wear and tear, the online store has the right to lower the amount returned in accordance with the decrease in the value of the goods.

5.6  To return the goods, you must submit a declaration of withdrawal (the form for which can be found here: declaration of withdrawal) to the e-mail address   within 14 days of receiving the goods.

5.7  The online store shall bear the cost of returning the goods, except in cases where the reason for the return lies in the fact that a refundable product does not comply.

The purchaser must return the goods within 14 days of the submission of the declaration of withdrawal or submit evidence that they handed over the goods to the carrier within the aforementioned period.

5.8  Upon receiving the returned goods, the online store shall return to the purchaser, immediately but no later than after 14 days, all of the payments received from the purchaser based on the contract.

5.9  The online store has the right to refuse to make the refund until the goods being returned are received or until the buyer has provided proof of returning the products, whichever occurs first.

5.10  If the purchaser has clearly chosen a different form of shipment than offered by the online store, the store is not required to compensate for the cost. Should you decide to use a different shipping method than the one indicated by the Vendor in the Return Form, you must instead pay upfront for the costs you have incurred for returning the purchased products. In that case, in accordance with consumer protection legislation, you will also be refunded an amount equal to the cost of the standard shipping of the purchased products, although you will not be refunded for any additional costs you incurred due to having chosen another kind of shipment and delivery or one that is faster than the standard method. In this case you will still be able to be held liable if the products are lost or damaged during transport, whether due to your negligent choice of carrier and/or the shipment methods.

5.11  The online store has the right to withdraw from the sale and demand that the goods be returned by the purchaser if the marked price of the goods in the online store is significantly lower than the market price of the goods due to an error.

5.12  All products under Accessories, Hosiery, Outlet category and panties are NOT REFUNDABLE, this information is also shown in the product information page.

 

6.  Defective goods

6.1  The online store is responsible for the non-compliance of goods sold to a purchaser with the terms and conditions of the contract or for deficiencies which already existed at the time of delivery. The purchaser has the right to turn to the online store within 14 days of the occurrence of a defect by e-mailing. The online store is not liable for any defects arising after delivering the goods to the purchaser.

6.2  If goods bought from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store shall return to the purchaser all of the payments involved in the contract of sale.

6.3  The online store will respond to the consumer ́s complaint in written form or in a form that enables written reproduction within 15 days.



7.  Direct marketing and processing of personal data

7.1  The online store only uses the personal data entered by the purchaser (including name, phone number, address, email and bank details) for processing the order and sending goods to the purchaser. 

7.2  The online store forwards personal data to the transport service provider in order to deliver the goods.

7.3  The online store sends newsletters and offers to the purchaser's e-mail address only if the purchaser has expressed their wish to receive them by entering their email address on the website and indicating their desire to receive direct mail.

7.4  The purchaser is able to opt out of offers and newsletters sent to their email address at any time by letting us know via email or by following the instructions in an email containing an offer.

 

8.  Settlement of disputes

8.1  All complaints made by a purchaser about the online store must be e-mailed to help@lingeriz.com .

8.2  If the purchaser and the online store are not able to settle the dispute by agreement, the purchaser may contact the Consumer Dispute Committee. You can review the procedural rules and submit a complaint here. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the online store. Resolution of disputes by the Consumer Dispute Committee is free of charge for the purchaser.

8.3  A purchaser may also turn to the dispute resolution bodies of the European Union.
